Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

This notice describes the privacy practices of Regen MDs and its physicians, staff, and other health care professionals. It explains how we may use and disclose your protected health information (“PHI”) to carry out treatment, payment, or health care operations, and for other purposes as permitted or required by law. PHI is information about you that may identify you and that relates to your past, present, or future physical or mental health condition and related health care services.

We are required by law to maintain the privacy of your health information, to provide you with notice of our legal duties and privacy practices with respect to your health information, and to notify you in the event of a breach of your unsecured health information.

1. How We May Use and Disclose Your Health Information

Treatment

We may use and disclose your health information to provide, coordinate, or manage your health care and related services. For example, we may share your health information with a specialist to whom we refer you for treatment, or with a laboratory performing tests related to your care.

Payment

We may use and disclose your health information to bill and collect payment for the services we provide. For example, we may provide information to a health plan so that it can process your claims. As a self-pay/cash-pay practice, payment disclosures are typically limited. Note: Under Florida law, your written authorization is required before we disclose health information to insurance companies for payment purposes.

Health Care Operations

We may use and disclose your health information for our health care operations, which include quality assessment and improvement activities, reviewing the competence or qualifications of health care professionals, conducting training programs, and general business management and administrative activities

2. Uses and Disclosures That Do Not Require Your Authorization

We may use or disclose your health information without your authorization in the following circumstances:

  • As Required by Law: We will disclose health information when required to do so by federal, state, or local law.
  • Public Health Activities: We may disclose your health information to public health authorities for the purposes of preventing or controlling disease, injury, or disability, and for reporting births, deaths, and suspected abuse or neglect.
  • Health Oversight Activities: We may disclose your health information to a health oversight agency for activities authorized by law, including audits, investigations, inspections, and licensure actions.
  • Judicial and Administrative Proceedings: We may disclose your health information in response to a court or administrative order, or in response to a subpoena, discovery request, or other lawful process, subject to Florida law restrictions described below.
  • Law Enforcement: We may disclose your health information to law enforcement officials under limited circumstances as permitted by law. Under Florida law, disclosures to law enforcement are more restricted than under federal HIPAA law and generally require your written authorization or a valid subpoena.
  • Abuse, Neglect, or Domestic Violence: We may disclose your health information to appropriate authorities if we reasonably believe you are a victim of abuse, neglect, or domestic violence.
  • To Avert a Serious Threat to Health or Safety: We may use and disclose your health information when necessary to prevent a serious threat to the health and safety of you, another person, or the public.
  • Workers’ Compensation: We may disclose your health information as authorized by, and to the extent necessary to comply with, workers’ compensation laws.
  • Coroners, Medical Examiners, and Funeral Directors: We may release health information to a coroner, medical examiner, or funeral director as necessary for their duties.
  • Organ and Tissue Donation: We may release health information to organizations that handle organ procurement or organ, eye, or tissue transplantation if you are an organ donor.
  • Mandatory Reporting: Florida law requires reporting of certain conditions (communicable diseases, gunshot wounds, suspected child abuse/neglect) to appropriate state authorities regardless of other privacy protections.

3. Uses and Disclosures That Require Your Written Authorization

We will obtain your written authorization before using or disclosing your health information for purposes other than those described in this notice. You may revoke your authorization in writing at any time. The following uses and disclosures require your written authorization:

  • Marketing: Use or disclosure of your health information for marketing purposes.
  • Sale of Protected Health Information: Any disclosure that constitutes a sale of your health information.
  • Psychotherapy Notes: Most uses and disclosures of psychotherapy notes (if applicable).

Other Uses: Any other use or disclosure of your health information not described in this notice.

4. Florida-Specific Privacy Notice

Under Florida law (F.S. § 456.057), your medical records are confidential. Florida law is MORE RESTRICTIVE than federal HIPAA law in certain areas. We may not disclose your health information to insurance companies for payment purposes, or to law enforcement, without your written authorization or a valid subpoena, even where federal law would permit such disclosure.

Florida law also prohibits the use of your health information for marketing or solicitation purposes without your specific written release. Third parties who receive your health information from us may not further disclose it without your written consent.

5. Your Rights Regarding Your Health Information

You have the following rights with respect to your health information:

  • Right to Access: You have the right to inspect and obtain a copy of your health information maintained by this practice. You must submit your request in writing. We may charge a reasonable, cost-based fee for copies as permitted by Florida law.
  • Right to Amend: You have the right to request that we amend your health information. Your request must be made in writing and must state the reason for the amendment. We may deny your request in certain circumstances and will provide you with a written explanation.
  • Right to Request Restrictions: You have the right to request restrictions on certain uses and disclosures of your health information. We are not required to agree to your request, except that we must agree to restrict disclosures to a health plan if you pay for the service in full out of pocket and the disclosure is for payment or health care operations purposes.
  • Right to Request Restriction for Self-Pay Services: If you pay for a service or health care item out of pocket in full, you have the right to ask us not to share that information with your health insurer for the purpose of payment or health care operations. We will agree to your request unless a law requires us to share that information.
  • Right to Confidential Communications: You have the right to request that we communicate with you about health matters in a certain way or at a certain location. For example, you may request that we contact you only at a specific phone number or address.
  • Right to an Accounting of Disclosures: You have the right to request a list of disclosures of your health information that we have made, other than disclosures for treatment, payment, health care operations, and certain other exceptions.
  • Right to a Paper Copy of This Notice: You have the right to obtain a paper copy of this notice upon request, even if you previously agreed to receive the notice electronically.

Right to Revoke Authorization: If you have provided us with a written authorization to use or disclose your health information, you may revoke that authorization in writing at any time. Your revocation will not affect any actions we have already taken in reliance on your authorization.

6. Our Duties

  • We are required by law to maintain the privacy and security of your protected health information.
  • We are required to notify you in the event of a breach of your unsecured protected health information.
  • We must abide by the terms of this notice currently in effect.
  • We will not use or disclose your health information without your authorization, except as described in this notice.

7. Changes to This Notice

We reserve the right to change our privacy practices and the terms of this notice at any time, provided that the changes are permitted by applicable law. We reserve the right to make the changes in our privacy practices and the new terms of our notice effective for all health information that we maintain, including health information we created or received before we made the changes. When we make a significant change in our privacy practices, we will change this notice and make the revised notice available upon request.
